DOJ Rule Change: Federal Employees Cleared to Download TikTok on Government Devices

WASHINGTON, D.C. — In a surprising policy reversal, the U.S. Department of Justice (DOJ) has cleared the way for federal executive branch employees to download and use the popular short-video application TikTok on their official government-issued devices.

The shift was formalized in a 12-page legal memorandum issued by the DOJ’s Office of Legal Counsel (OLC), titled Application of the No TikTok on Government Devices Act to the TikTok USDS Joint Venture.

Why the Ban Was Lifted

The federal government originally banned TikTok from official technology in late 2022 due to national security concerns regarding data privacy and the app's parent company, ByteDance Limited, which is headquartered in Beijing, China.

However, according to the newly released memorandum opinion, a restructuring of the app’s operations has satisfied federal security standards. The DOJ noted that the version of the app now available in the United States is operated by the TikTok U.S. Data Security (USDS) Joint Venture, which:

  • Functions independently of ByteDance.

  • Is majority-owned by American investment firms (including Silver Lake, Oracle, and MGX).

  • Has completely overhauled its content-recommendation algorithm and cybersecurity infrastructure to fully insulate U.S. government data from foreign oversight.

What This Means for Federal Workers

While the DOJ has determined that the app no longer violates the statutory ban, the decision to allow downloads is not a blanket mandate. The White House has instructed executive branch agencies that employees may use TikTok on official devices subject to individual agency discretion and in alignment with existing workplace and IT policies.

Federal employees are advised to check with their specific agency’s IT and compliance departments before downloading the application.
